UAE’s Labour Law states certain circumstances under which an employer is allowed to dismiss an employee without providing notice. These are few certain conditions e.g. if an employee makes a loss, intentionally or unintentionally, goes beyond the objectives & interests of employer and bring a bad reputation, commit fraud by using employer or company’s name. These certain conditions make the employer capable of dismissing the employee, without giving any notice.
Apart fro these, if the employer terminates an employee, without any solid and genuine reason, then the employee has right to file the complaint against the employer. UAE’s Labour law will protect the employee and he will be provided compensation as well.
According to UAE Labour Law, the employee cannot be forced to resign his job, if there is no real issue or dispute. If an employer does so, then the employee has right to move to court for justice. The employer has no rights to hold the passport if the employee has completed the contract or wants to quit the job if possible (according to contract).
It is also seen in many cases that passport is kept as the guarantee in different business transactions. If someone keeps it for guarantee purposes, then it will be just considered as Document by the court. The only court has the authority to hold a passport for guarantee purposes.
Passport, wrongful termination or any other Legal Issue regarding these, is completely defined in UAE Labor Law. Nothing goes beyond the Law in UAE and this is one of the biggest reason of prosperity and progress in UAE.
